オーストラリアにおけるジェンダーに関する法曹継続教育序論

Abstract

本稿は、ジェンダーに関する課題を中心に法曹継続教育についての比較研究を行うため、2008年2月～3月および2009年2月にオーストラリア、ニューサウスウェールズ州（NSW）シドニーにおいて実施した調査に基づき、オーストラリアにおける法曹継続教育についてジェンダーを中心に考察することを目的としている。まず、オーストラリアにおける、法曹の階層化と法曹一元制度を特徴とする英国型の法曹制度、法曹養成について、ジェンダーの側面も交えて概観する。次に、とくにNSWにおけるソリシターの継続教育のあり方について、弁護士会によるプログラムは、法令に沿って差別につきセミナーが提供されていること、法曹人口の半数に迫る女性法曹のニーズに応えるものであるとともに、専門家の私的自治としての継続教育には限界もあることが指摘される。裁判官の継続教育について、NSWの特徴的な独立委員会である司法委員会の設置経緯と任務をみる。情報提供や教育内容から、裁判官の独立と教育、司法の独立と市民の信頼について考察する。

As one of the results of the research project, "International Comparative Research on the Process of Developing, Implemeting, Systematizing Continuing Legal Education Programs Concerning Gender Issues," (a three year research project with the government's Grants in Aid for Scientific Research) , this article addresses continuing legal education system in New South Wales, Australia, which is a leading system in Australia, as well as it is expected to be a model for the Asia-pacific region. Mainly focusing on the solicitor's continuing legal education and judicial education, this article finds gender issues are programmed not as a theoretical matter, but as matters of interpretation of statutes and practical court management. As such, gender programs have their own place, and that is because Australia has a comprehensive legal system on gender issues.
