法学の学問システムへの開放？ : ドイツ学術審議会『ドイツ法学の視座 : 状況・分析・勧告』（2012年）を素材に

Abstract

本稿は、2012年にドイツ学術審議会により公表された『ドイツ法学の視座：状況・分析・勧告』の概要を素描し、一方でそこで示されたドイツ法学に特徴的な法ドグマーティクの方法、他方で基礎科目のあり方の考察を通じて、本勧告の内容と意義、そしてそれに通底する法学の学問システムへの開放という考え方の中身を明らかにすることを目的とする。法学は法適用者を補助する法ドグマーティクによって法システムと結びつくが、そこでは基礎科目の認識が構造上排除される傾向があるため、学際的・学領域内的な基礎科目により、それを外側から「学的に」観察する道筋を制度化する必要がある。もっとも、本勧告が示す基礎科目の強化は、下位分野の分化自律によって法学の一体性を瓦解させるジレンマを同時に抱えるため、これを回避するには、一見逆接的に思われるが、法学の中心に位置する法ドグマーティクとの結びつきに絶えず注意を払う必要があるだろう。In 2012, a report Prospects of Legal Scholarship in Germany. Current Situation, Analyses, Recommendations was published by the German Science and Humanities Council. In this paper, I examine the method of German legal dogmatics （Rechtsdogmatik） on the one hand, the foundational subjects in legal scholarship on the other hand, in order to clarify the underlying concept of the report to open up legal scholarship towards the scientific system, other academic disciplines and the wider system of higher education and academic research. This report proposed to strengthen the foundational subjects, but I suppose it would face a dilemma of disintegrating the unity of the discipline of the legal science as a whole through the differentiation into sub-disciplines. To avoid this dilemma, the foundational subjects should always take the connection with legal dogmatics into consideration, although it may seem paradoxical at first glance.
