Abstract

少子化と高齢化が急速に進行する日本で、これに関連する諸課題を検討するときに、すぐに突き当たる問題は、男女が結婚し、こどもを産み育て、家庭生活を営むのは、まったく私的、個人的なことか、それとも公共性を有することなのか、という問いである。婚姻や出産、育児に関する重要なことが、最終的には当事者個人の意志で決定されるべきことについては、社会的な合意が形成されつつあると思われるが、この当事者たちの意志決定に国家や社会が法、制度、慣行などを改廃することによって関与することが許されるか、許されるとしたらそれはどのような仕方でか、が問題である。本稿では、このような問題について、具体的な事例を挙げながら、広く検討していきたい。

In contemporary Japan, where the decline in the number of children and the aging of the population have rapidly advanced, one question we face when we consider problems related with these facts is, whether it is a completely private and personal matter or a public concern, for a man and a woman to get married, bear and bring up children, and live a family life. As to the view that the man and the woman concerned should make the final decision about such important matters, a social consensus seems to be formed now, but the question is if the state or society is permitted to participate in this decision-making process by some reform of laws, social systems, and practice, and when permitted, how. In this paper I will discuss these problems through making reference to concrete examples.
